Welcome to www.partyfunk.fun (hereinafter referred to as the “site”). We are a digital platform connecting interested people to curated house parties held by independent hosts and parties held in resorts all across India. By using this website, any mobile application or digital application or subsidiary owned by or created by the owners of this site (unless completely and ultimately separate from the functioning of this site), you acknowledge, your understanding and agree to be bound by the following terms and conditions (“Terms”), and/or any segment including but not exhaustive of our privacy policy, cancellation and refund policy, code of conduct and community guidelines, and compliance with the consent of Intellectual Property rights.

The terms “you”, “your”, “yours”, “the user”, refer to individually and collectively (as the case may apply to) but is not limited to the users of this site including a host, guest, visitor etc.

You are advised to read through the terms carefully and then continue on to use the site. By agreeing to the terms and conditions by ticking the consent box on the login page you agree to abide by the rules and acknowledge that you have read and understood the terms and conditions governing the actions and consequences of the user in use of the site and it’s services.

These terms create a legally binding agreement between you and the site.

User Eligibility

User must be 21 years of age and above and must be capable of entering into legally binding and valid contracts for using this site. You are required to give a declaration while logging in by means of an age confirmation checkbox. It is the user’s responsibility to make sure the information they’re providing by agreeing to this is true. The site does not knowingly collect information from or allow individuals under the age of 21 to be a user of this site.

Verification and Screening Policy

The site runs verification and screening of user requirements through necessary checkboxes. It is the user’s responsibility to ensure that the information furbished by them is true. In case it is not the site shall not be liable for damages and the liability falls solely upon the individual providing the information through the verification.

Attendees must carry the e ticket provided to them along with a valid government id for entry into the party.

The site does not run background checks on the attendee’s or host’s criminal record or background or moral character. The website shall not be liable or user actions and the responsibility for other users lies with the users themselves

Registration and Account Creation

Attendees:

The users are required to login through their emails and set up their own passwords at time of login. It is necessary for the users to make sure that the emails are correct and active. Any booking confirmation or e tickets will be sent to the email accounts registered with the site. The users must fill in the necessary checkbox verifications to proceed with their login activity.

Party hosts:

In order to register as a host and list a house party on the site the host must provide any government id, legal name, address, phone number, location of hosting and a clear video of the hosting area and an active email address. The user seeking such permission will go through a preliminary scanning by the partyfunk team and be notified by email if he is eligible to be a host with us. The user is himself responsible for maintaining the confidentiality of his login credentials.

Scope of partyfunk.fun

partyfunk.fun is an online directory and booking platform for ongoing and upcoming house parties across India. For parties held by the users registered as hosts, the site only acts as a listing and booking facilitator and provides services for help in setting up the event. The Site acts solely as a venue in case of house parties; it is an organizer or host merely of any event where it is explicitly mentioned to be one in the booking details or the advertisement. Users are solely responsible for their use of the Site and any resulting transactions.

We are not a party to any agreement between users. Even if the Site facilitates bookings or communications, the quality, safety, legality, and execution of the event is the responsibility of the users involved.

The site does not insure any damages caused to the attendees. Users are responsible for their own items and their safekeeping throughout the event.

Booking and payment

The users who wish to attend any party may by clicking on the advertisement of the party on the site go through the details. Confirmation mail for attendance will be sent to registered email after the payment of the requisite amount for the party through Razor Pay gateway.

The attendees must show their online QR ticket at the venue to be granted entry to the event. This QR shall be shared along with the confirmation mail or through a separate mail later. In case after completion of the payment user has not received the ticket for entry they may email the company at partyfunk.help@gmail.com along with the payment screenshot, username, registered email account (the account used at the time of logging in to the site), time of booking, party details, name of the host as mentioned. The playfunk team will get back to you within two business days after looking into the matter.

Booking charges and service fees

The booking charges for a party are decided on by a host himself. It is the price originally showed in the listing

The site charges a nominal amount in addition to the booking fee for the users for the GST tax and service tax. This fees is displayed at the checkout page and the total amount in displayed after addition of the fees and booking amount. Please take note that in case of cancellation service fees is non refundable.

Site usage

Users are granted a limited, revocable, non exclusive license to use the platform in accordance with the terms and conditions. Unauthorised use, including deep – linking, framing, reverse engineering, or any such use in any other form is strictly prohibited.

Users are informed that in an event of happening of such an event, the site reserves the right to ban the user for the site temporarily or permanently, at the discretion of the site. The user shall be liable for payment of any amount which the site incurred as damages due to such conduct. Failure to do so will lead to charges for breach of contract.

Listing a party by event organisers

An user registered as a host may list parties by providing event details, pricing amenities, and house rules. Organisers are solely responsible for fulfilling and stating all the information and commitments stated in the listings. These details will be displayed in the listing ad.

Listing a party by the site

Events being hosted by the site will have partyfunk mentioned as the host in the listing itself. In this case it is the responsibility of the venue being booked by partyfunk for such parties to make sure they have all the appropriate licensing to hold the event (including alcohol license, trade license, Fire Safety NOC, license related to public entertainment, music etc.)

If any listing is found to be in violation any laws the site may disable it. Such host shall be given a warning in the scenario. More than two similar events by the host in a span of a year will lead to a complete ban from the website.

Booking house parties

Users are required to place a booking request. Such bookings are final and can be cancelled up to 48 hours from before the time of start of the party. A reservation is confirmed only when accepted by partyfunk and the payment is processed by the website.

The refund in case of cancellation in compliance with the above mentioned condition will be processed within 3 – 5 business days. The refund in any scenario will not include:

• Non refundable fees
• Service fee
• GST or tax.

Safety and Risk

The users are responsible for responsible and safe interaction with strangers at the parties at any given time. Users must behave appropriately as per the code of conduct and be respectful of the house rules at every point of time. Users are to avoid any form of violence or harassment against each other at any given point during the party. Actions of such nature shall cause immediate expulsion of the user from the party and a formal warning. If the behaviour continues or escalates, the user might face a temporary or permanent ban from the website.

The site shall not be responsible for any connections made by users outside the event or for post – event interactions

The site shall not be responsible for any third party connection (sharing of phone number, or any other means of contact) made by users with each other during or through the event. If a user voluntarily shares his/her information with another user, the site shall not be liable if it results in stalking, misuse of data or any other risks so involved. Such liability shall lie with the users involved in such an altercation.

Users voluntarily accept all the risks involved and associated with attending such events. The site does not guarantee the moral character of the users involves and shall not be liable for any personal injury, loss or death caused due to the actions of the users.

Property Damage

In case of any damage caused to the property during or at the time of event shall render the attendee liable for such damage. The attendee shall be liable to pay a fine equivalent to:

The price of the damaged object + 500 rupees.

This fine shall be payable at the very party by the user. User shall not be allowed to leave before making the payment. If the user fails to do so he shall be handed over to the nearest police station having the jurisdiction and be permanently banned from attending or organising parties through the site.

The hosts are fully responsible for any legal or financial liability for the events held at their place.

Prohibited Conduct

Users are strictly prohibited from using this site for the following:

• Making offline reservations including hosts in order to bypass partyfunk (the site) and avoid service fees for any party which is already listed or shall be listed on the site in the future. In case of such action, the user(s) shall be liable to compensate the site for any damages incurred for such action.
• Posting any adult content or using language which is considered explicitly abusive or is aimed at harming a person’s modesty or is meant to defame a person or the site, or any other user.
• Provide false information with the intention to defraud, cause mischief or fear among the peers, defame, misrepresent, spread rumours, promote a brand or entity without explicit permission from the site, cause annoyance, inconvenience, insult or injury to any person or organisation or do anything prohibited by any laws in India.
• List the same event multiple times on the platform.
• Contact other users outside of the platform to bypass fees and tax.
• Promote any brand, organisation, person or entity without permission from the site.
• Violate code of conduct and explicit house rules stated by hosts.
• Promote or cause violence or act in a manner which endangers the people at the party.
• Carry weapons of any sort or drugs.
• Abuse, harass or assault anyone.
• Violate any other laws prevalent in India.

If any user violates such terms and conditions he/she shall be liable to legal action. The site shall not be liable for any of the violations by the users. The site has a zero tolerance policy for any of the above mentioned acts and in case of any criminal acts the site shall report the event to the police for such act and provide the user data involved in the criminal activity to the law enforcement authority.

Review and Submission

By submitting content (reviews, photos, suggestions, etc.), you grant partyfunk.fun a royalty-free, perpetual, and worldwide license to use, reproduce, and display such content. Submissions are non-confidential and non-proprietary.

Termination

The site reserves the right to suspend or terminate access to the site at our discretion if you:

• Violate these terms
• Provide any false information
• Pose legal liability to other users or to the site.
• Violate any laws

Disclosure of information

We may report any suspected illegal activity to law enforcement and cooperate with investigations as required.

Legal Compliance

By agreeing to the terms and conditions you agree to comply with all applicable laws and regulations. These Terms are governed by the laws of India.

By agreeing to the terms and conditions the user agrees to forego and waive his right to be a party or act as a plaintiff in any class action, collective or representative action or lawsuit against the company.

By agreeing to the terms the user that is the covenant agrees to waive his right to file or initiate any lawsuit or legal proceedings against the platform or its affiliates for any claims covered or not covered by this agreement. If a person is in violation of this agreement he shall be liable to pay for all costs, including attorney’s fees incurred by the platform in defending such action. The users, in case of disputes shall address it primarily and only by means of arbitration as mentioned in section.

ARBITRATION CLAUSE

Any dispute between the user and the site shall be resolved by Arbitration and only Arbitration under Arbitration and Conciliation Act, 1996 with Kolkata as the seat of arbitration. The site, however, retains it’s right to bring proceedings against any user for violation in any appropriate jurisdiction.

INDEMNITY

You agree to indemnify and hold harmless partyfunk.fun and its affiliates, employees, and agents from any claims or liabilities arising out of your use of the Site, including breach of these Terms or violation of any third-party rights.

INTELLECTUAL PROPERTY RIGHTS

All content on the Site is owned by partyfunk.fun or its licensors and protected under applicable intellectual property laws. Unauthorized use, reproduction, or distribution of Site content is strictly prohibited.

MODIFICATION

We may revise these Terms from time to time. Continued use of the Site following such changes indicates your acceptance of the updated Terms. If you disagree, please discontinue use of the Site.

NOTICES

Notices, queries or information to partyfunk.fun should be sent to the contact emails listed on the Site. Notices, queries or communication to you will be sent to your registered email address and are considered delivered one business day after being sent.

SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

ENTIRE AGREEMENT

These Terms constitute a legally enforceable agreement between you and partyfunk.fun regarding use of the Site and supersede all prior agreements. No modification shall be valid unless in writing and authorized by us.
